Agreement
These terms are between your clinic and SwainUK Limited (company number 16224562). By using HonestFace you agree to them and to Apple's Standard Licensed Application End User License Agreement, which also applies.
Subscriptions
- Plans are sold through the App Store and billed by Apple to your Apple Account.
- A subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
- If a free trial is offered, it turns into a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends.
- Manage or cancel in the Settings app › your name › Subscriptions. Refunds are handled by Apple at reportaproblem.apple.com.
- The free plan has limits shown in the app. Records you already made stay available if a plan ends.
Your responsibilities
- Your clinic is responsible for patient consent, for the lawful basis for holding records, and for every clinical decision.
- Keep the Clinic Recovery Key and backup passwords safe. We cannot recover them or read your encrypted data.
- Keep staff PINs private and remove staff and iPads that should no longer have access.
- Use HonestFace only for lawful clinical record keeping. Don't try to break its security or use it to harm anyone.
Not a medical device
HonestFace records and organises photographs and documents. It does not diagnose, measure for treatment or recommend treatment. Guides and overlays help line up photos only. The consent templates are drafts: your clinic must review them, ideally with its own adviser or insurer, before use.
Availability
HonestFace works offline on the iPad. Cloud sync and emails may sometimes be unavailable. Keep backups: automatic backups are on by default once a Clinic Recovery Key is set up.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else that can't be limited by law. Otherwise, SwainUK Limited is not liable for loss of profit, business or goodwill, or for indirect losses, and our total liability in any 12 months is limited to the subscription fees you paid in that period. If you are a consumer, your statutory rights are not affected.
Ending
You can stop at any time and delete your account in the app. We may suspend accounts that break these terms or put others at risk, and will tell you why where we can.
Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
